I-2066 Compliance

There has been confusion over the WA energy codes and the passage of I-2066, and how the codes should be enforced. The Council has debated this at length and heard from the public. There are numerous laws that require the WA energy codes to meet certain requirements, including increasing energy efficiency, meeting requirements for cost, a public process, and the I-2066 initiative. The Council is investigating any changes necessary, if needed to bring the codes into compliance with the requirements under I-2066 and all other relevant laws. Until such time as the Council adopts any changes, the current 2021 codes will remain in place.

2024 Codes Delay

The 2024 Washington Building Codes are being developed on a compressed schedule created by carried over delays from the 2021 code development process. SBCC staff have requested an adjustment to the 2024 Code development schedule to accommodate the final processing steps in the rulemaking procedures required by the Washington Administrative Procedures Act, Regulatory Fairness Act, and State Building Code Act.

During the SBCC meeting on Sept. 26, the Council unanimously approved to delay the final adoption of the 2024 Washington State Building Codes until May 2026. The SBCC action also adjusted the public comment period for Group 1 & 2 amendment petitions, now opening February 18 and closing March 27, at the conclusion of the required public comment hearings. At this time, the SBCC will be maintaining the November 1, 2026 effective date of the 2024 WA Codes, pending legislative action changing or suspending requirements of RCW 19.27.074.
